The suit, filed in the Southern District of California, alleges that Hawthorne Machinery and other defendants engaged in Paycheck Protection Program (PPP) fraud, obtaining an over $8 million loan by claiming the company and its affiliates were a small business with fewer than 500 employees, when they actually had more than 500 employees and omitted affiliates and employees to represent themselves as smaller than they actually were.
After declination, Mr. Craig elected to litigate the case on behalf of the government, as whistleblowers are entitled to do under the False Claims Act.
The case is currently pending decision on the defendants’ motion to dismiss, which we opposed on Mr. Craig’s behalf.
